Oklahoma’s DUI Attorney
If you have been accused of an alcohol-related driving offense in Oklahoma, it is important you understand the charges you are facing. There are several different types of alcohol-related charges a person can face: driving under the influence of alcohol (DUI), driving while impaired (DWI), and actual physical control (APC) of a motorized vehicle while intoxicated. It is no secret that a DUI conviction can have life-altering consequences. Not only do you run the risk of losing your driver’s license, your employment could be affected as well as your insurance rates. Add all this on top of substantial fines and possible jail time means a DUI conviction can have a long-lasting impact on your daily life.
In Oklahoma, a DUI can be charged as either a misdemeanor or a felony. The severity of the charge will be based on several different factors. If this is your first DUI and first arrest overall, the charge will likely be a misdemeanor. In order for a DUI to be charged as a felony, you must have a previous DUI charge from a court of record within the last 10 years. In the event you were charged with a DUI in the past but the charge was reduced to reckless or careless driving, your new DUI will be filed as a misdemeanor.
Understanding DUI in Oklahoma
Depending on how your DUI is filed, you could face a minimum of up to 1 year in jail and/or a fine of up to $1,000 for a misdemeanor. The severity of your punishment will depend on several different factors. To learn more about the laws specific to Oklahoma City, Norman, or the surrounding areas, please contact Worden Law Firm. In Oklahoma, a DUI charge is usually based on the blood alcohol content (BAC) of an individual. This is determined by a breathalyzer test measuring the alcohol in a person’s bloodstream, administered by the officer at time of arrest. However, a refusal to test can still result in a DUI charge.
The BAC limit for people over the age of 21 in Oklahoma is .08% or higher. However, if you test under the .08% level, you may still face penalties or be subject to a DWI charge.
