- The person was in actual physical control of a vehicle;
- On a public road, street, highway, turnpike, private road, alley or public parking lot;
- While having a BAC of .08% or higher/while under the influence of alcohol and/or any intoxicating substance, which may render a person incapable of safely driving a motor vehicle;
- The blood test or breathalyzer was administered within two hours after the arrest.
These are just a few key points to keep in mind when faced with an APC charge. Again, DUI and APC are interchangeable in Oklahoma, with a few small exceptions.
